§1 Technical Dependencies & Compatibility
- 1.1 Some features of Windows Cockpit rely on advanced interactions with Windows, system-specific workarounds, situational system modifications, third-party components, and, in some cases, unofficial, undocumented, or non-public interfaces and APIs.
- 1.2 Due to these technical dependencies, VIVRE-MOTION cannot guarantee that all features will function fully, permanently, or identically across every Windows version, system configuration, or language version. Differences between Windows versions, updates, system settings, language versions, and individual system configurations may affect the behavior of certain features.
- 1.3 Changes to Windows or other underlying system components may also result in certain interfaces, workarounds, or technical methods being restricted, modified, or disabled entirely.
§2 External Services & Third Parties
- 2.1 Certain Windows Cockpit features depend on external services, applications, components, or interfaces provided by third parties. Their availability, functionality, and technical behavior are outside the control of VIVRE-MOTION and may be changed, restricted, or discontinued at any time.
- 2.2 This particularly applies to features that rely on unofficially supported or undocumented interfaces, web services, or comparable technical methods. This includes, among others, the integration of Google Web Translate.
- 2.3 Changes made by Microsoft, Google, or other third parties may therefore cause individual Windows Cockpit features to become temporarily or permanently limited or unavailable.
§3 Licenses & Terms of Use
- 3.1 License terms, terms of use, policies, and other legal or technical requirements imposed by Microsoft, third parties, component providers, or external services may change at any time.
- 3.2 VIVRE-MOTION reserves the right to adapt or restrict Windows Cockpit and individual features, replace them with alternative technical solutions, or — where continued provision is no longer permitted, technically feasible, or reasonably achievable under the changed conditions — remove them entirely.
- 3.3 Compliance with applicable license terms, terms of use, policies, and other requirements takes precedence over maintaining any particular feature.
§4 Privacy & Local Processing
- 4.1 Privacy and the responsible handling of data are of high importance to VIVRE-MOTION.
- 4.2 Where technically possible and unless otherwise required for a particular feature, Windows Cockpit operations are performed locally on the user's system.
- 4.3 For features whose functionality requires the use of an external service, communication over the Internet is technically necessary. This applies, for example, to translations performed through external services such as Google Translate, as well as certain AI-based features and operations.
- 4.4 In such cases, the data required to perform the respective operation may be transmitted to the relevant external service and processed in accordance with that provider's applicable privacy policies, license terms, and terms of use. VIVRE-MOTION strives to limit the transmission of data to external services to what is necessary for the respective feature.
§5 Telemetry & UID.X
- 5.1 When the software is launched for the first time, a random identifier in the form of a UUID as defined in RFC 4122 is generated. During plugin startup, the software attempts to send a status ping using this identifier in order to obtain basic insights into the use of the software. Multiple transmission attempts may occur during the startup process, for example if a previous attempt was unsuccessful. UID.X does not perform continuous telemetry during normal plugin operation.
- 5.2 The UUID contains no personal information and no device-related information. It is not linked to IP addresses or any other data sources and is not shared with third parties. The intended implementation does not provide a technical means of associating the UUID with a specific person or device.
- 5.3 The implementation of UID.X is designed around the principle of data minimization. Only the information required for the purpose described above is processed, and no additional personal or device-related information is incorporated into the UUID.
- 5.4 VIVRE-MOTION considers the UUID used in this manner not to constitute personal data within the meaning of Article 4(1) of the GDPR, due to the absence of an intended means of attribution or re-identification. The implementation is designed in accordance with, in particular, the principle of data minimization under Article 5(1)(c) of the GDPR.
§6 Continued Development & Long-Term Availability
- 6.1 VIVRE-MOTION strives to maintain the functionality of Windows Cockpit over the long term and to continuously adapt the software to changes in Windows, external services, interfaces, and other technical conditions.
- 6.2 Where reasonable and technically feasible, VIVRE-MOTION will attempt to provide appropriate adaptations or alternative solutions when existing technical methods become unavailable or are changed.
- 6.3 However, due to technical limitations, changes made by operating system vendors or third parties, changes to license terms or terms of use, or disproportionate technical or economic effort, VIVRE-MOTION cannot guarantee that every feature can be permanently maintained, adapted, or replaced with an alternative solution.
- 6.4 VIVRE-MOTION therefore reserves the right to modify, restrict, replace, or discontinue individual features where necessary.
